While disagreements between the Supreme Court and Congress do occur, this is not what political scientists mean by "divided government." The term specifically refers to partisan control of the elected branches. Conflicts between federal and state governments relate to federalism, not divided government. While split control of the House and Senate (with different parties controlling each chamber) can create legislative challenges, divided government most commonly refers to the split between the executive and legislative branches.

Political scientists debate whether divided government is harmful or beneficial. Critics argue it leads to legislative gridlock, blame-shifting, and government shutdowns. Supporters like David Mayhew have argued that divided government does not necessarily reduce legislative productivity  -  significant laws have been passed during periods of divided government.
