The Constitution did not explicitly grant the president power to acquire new territory. The Louisiana Purchase posed a significant constitutional dilemma for President Thomas Jefferson, who was a strict constructionist  -  he believed the federal government could only exercise powers explicitly granted in the Constitution. Since the Constitution contained no provision authorizing the president to purchase foreign territory, Jefferson privately acknowledged that a constitutional amendment might be needed. However, fearing that Napoleon might withdraw the offer, Jefferson ultimately set aside his strict constructionist principles and completed the purchase.

France willingly sold the territory  -  Napoleon offered it to American envoys James Monroe and Robert Livingston, who had originally been sent only to negotiate the purchase of New Orleans. Spain had already ceded the territory back to France in 1800, so there was no joint British-Spanish claim. While there was some opposition in Congress, particularly from Federalists who feared the new territory would dilute New England's political influence, the Senate ratified the treaty by a vote of 24 to 7.

The Louisiana Purchase doubled the size of the United States and set precedents for executive authority that extended far beyond what Jefferson's own political philosophy would have predicted. It demonstrated that practical necessity could override strict constitutional interpretation, a lesson not lost on future presidents. The acquisition opened vast western lands for American expansion, set the stage for the Lewis and Clark expedition, and intensified debates over whether slavery would be permitted in new territories  -  a question that would dominate American politics for the next sixty years.
