Which provision of the Compromise of 1850 was most controversial in the North?

Question

Accepted Answer

The Fugitive Slave Act. The Fugitive Slave Act was by far the most controversial provision of the Compromise of 1850 in the North. It required Northern citizens to assist in the capture and return of escaped slaves, imposed heavy penalties on anyone who aided fugitives, and denied accused runaways the right to a jury trial. Many Northerners who had previously been indifferent to slavery were radicalized by the law's requirement that they personally participate in the institution.

The admission of California as a free state was actually welcomed by most Northerners, as it tipped the balance in the Senate in favor of free states. The abolition of the slave trade in Washington, D.C. - though not slavery itself - was seen as a modest victory for antislavery forces and drew little Northern opposition. The organization of New Mexico Territory under popular sovereignty was less immediately controversial because the region's arid climate made it unlikely to attract slaveholders.

The Fugitive Slave Act is a critical topic on the DSST exam because it demonstrates how the Compromise of 1850, rather than settling the slavery question, actually intensified sectional conflict. The law inspired Harriet Beecher Stowe to write Uncle Tom's Cabin, prompted Northern states to pass personal liberty laws to obstruct enforcement, and convinced many Northerners that a "slave power conspiracy" was controlling the federal government.
